1. Introduction
These terms govern your use of SpareIt ("the Platform"). By registering or using the Platform you agree to these terms.
2. The Platform
SpareIt is a peer-to-peer marketplace that facilitates the buying and selling of vehicle parts between private individuals and traders in South Africa. SpareIt is not a party to any transaction between buyers and sellers.
3. Buyer Protection
All purchases made through the Platform are covered by SpareIt Buyer Protection. A fee of 7% of the purchase price plus R25 is charged to the buyer at checkout. This fee covers you if:
- The item is not received within a reasonable timeframe
- The item is significantly not as described
- The wrong item is sent
Buyer Protection only applies to purchases made through the Platform. Payments made outside the Platform are not covered.
4. Escrow
Payments are held in escrow by SpareIt until the buyer confirms receipt of the item, or 5 days after the seller marks the order as shipped — whichever comes first. Funds are then released to the seller.
5. Seller Obligations
Sellers must accurately describe items, ship promptly once payment is received, and provide valid tracking information. Sellers may not list counterfeit, illegal, or stolen parts.
6. Prohibited Items
The following may not be listed on SpareIt: stolen parts, counterfeit parts, airbag components, items requiring specialist certification to sell, and any item prohibited by South African law.
7. Disputes
Disputes must be raised within 5 days of the order being marked as shipped. SpareIt will mediate and make a final decision. SpareIt's decision is binding.
8. Fees
Listing is free. SpareIt earns revenue through the Buyer Protection fee charged to buyers. There are no seller fees in the current version of the Platform.
9. Limitation of Liability
SpareIt's liability is limited to the transaction value in dispute. SpareIt is not liable for indirect or consequential losses. Parts sold are used unless stated otherwise — buyers accept appropriate wear and condition.
10. Governing Law
These terms are governed by the laws of the Republic of South Africa.
